1. Acceptance
These terms govern the use of the maquiven.com website, its subdomains and the Maquiven mobile apps (together, "the platform"). By signing up, publishing a listing or simply browsing the platform you accept these terms and our Privacy policy.
If you do not agree with any of them, please do not use the platform.
2. What Maquiven is
Maquiven is a platform with two services: equipment listings, where individuals and companies offer machinery, trucks and equipment for sale or rent and interested parties contact them; and procurement, where Maquiven publishes the equipment and service needs of companies in the sector and receives suppliers' proposals.
In listings, Maquiven does not own the equipment, does not act as seller, buyer, agent or broker, and takes no part in negotiations, payments, deliveries or transfers between users. Nor does it charge any commission on sales or rentals. Procurement is governed by the "Procurement" section. Brands identified as "Official partner" have a promotional agreement with Maquiven.
3. User accounts
- You must be at least 18 years old and legally able to enter into contracts.
- Your registration details must be accurate and kept up to date.
- You are responsible for keeping your password confidential and for all activity under your account; tell us immediately if you suspect unauthorised use.
- You can close your account at any time from "My account".
4. Publishing listings
By publishing a listing you represent and warrant that:
- you own the equipment or are authorised to offer it;
- the description, year, operating hours, mileage, condition and price are truthful and not misleading;
- the photos show the advertised equipment and you have the right to use them;
- the equipment is not stolen, carries no hidden liens and may be lawfully sold;
- the price is stated in USD, as a sale price or as a rental rate with its unit, or shown as "Price on request".
Listings of illegal or dubious-origin items, misleading advertising, duplicate listings of the same machine and contact details or links inside photos are not allowed.
5. Fees and payments
Publishing a listing carries a flat USD fee for the period shown before payment. The optional "Featured" and "Renewal" services have their own fees. Current prices are shown on the How it works page and in the summary before payment.
When card payment becomes available, it will be processed by Stripe; Maquiven never receives or stores your full card details. Where the method is available, you can also pay by Pago Móvil in bolívares at the exchange rate shown when you start the payment; the service is then activated once we have verified your payment by hand.
Fees pay for a publishing service already rendered and are therefore non-refundable once the listing goes live, except for errors attributable to Maquiven, duplicate charges or where applicable law provides otherwise. If a listing is rejected during review before going live you can correct and resubmit it without paying again.
6. Moderation
We may review listings before or after publication and reject, hide, re-categorise or remove those that breach these terms, and suspend or block accounts that breach them seriously or repeatedly. Where possible we will tell you why.
7. Dealings between buyers and sellers
Sales, rentals, transport or any other agreements are made exclusively between users. Maquiven does not guarantee the existence, condition, quality, legality or price of the equipment, the accuracy of listings or the ability of the parties to fulfil what they agree.
We recommend inspecting the machine before paying, checking the paperwork and the seller's identity, and being wary of urgent deposit requests or payments to third parties.
8. Procurement
Maquiven publishes procurement requests on behalf of client companies. For confidentiality reasons, it may show only the type of client and the area.
Proposals are sent to Maquiven, which reviews them and chooses, at its discretion, the one that best fits the requirements. Publishing a procurement request creates no obligation to award it: it may close without any proposal being chosen, change its conditions or remain subject to the client's award. Details marked "To be confirmed" are specified before the award.
By sending a proposal you declare that the data and documents you provide (equipment, licence plates, permits, insurance policies and certificates) are truthful and current. If your proposal is chosen, the terms of the service will be agreed in a separate contract.
The free plan lets you submit a limited number of proposals per month, shown on the Plans page. The Supplier Pro plan is paid for in 30-day periods by Pago Móvil, in bolívares at the BCV rate of the day. It does not renew automatically: we remind you before it expires and you renew it by paying for the next period. You can stop renewing it whenever you like. Its current price is shown on the Plans page and it is non-refundable once activated.
9. Content and intellectual property
You keep ownership of the content you publish. You grant us a free, non-exclusive, worldwide licence to host, reproduce, adapt (for example resizing photos or generating social-media images) and display it on the platform, in its apps and in its promotion for as long as the listing exists.
The Maquiven brand, the site design and its software belong to ASAD Technologies L.L.C-FZ, which grants Servicios ESOL Operations Leaders, C.A. a licence to operate the platform.
10. Prohibited use
- Sending spam or unsolicited bulk messages to other users.
- Extracting data from the platform by automated means (scraping) without permission.
- Impersonating another person or company, or creating accounts with false details.
- Attempting to breach the platform's security or interfering with its operation.
- Using the platform to commit fraud or any unlawful activity.
11. Limitation of liability
The platform is provided "as is" and "as available". To the extent permitted by law, Maquiven is not liable for damages arising from transactions between users, from content published by third parties or from service interruptions beyond its control. Our total liability to any user is limited to the amount that user paid Maquiven in the twelve months before the event giving rise to it.
12. Changes to these terms
We may update these terms to reflect changes in the service or the law. We will publish the new version with its date and, if the change is significant, announce it on the platform or by e-mail. Continued use means you accept the current version.
13. Governing law
These terms are governed by the laws of the Bolivarian Republic of Venezuela. Any dispute will be submitted to the competent courts of Venezuela, without prejudice to the rights the law grants consumers.
